You have practiced the process of selecting a proper defense, and briefing cases. Now you will combine these processes by selecting a case to brief and identifying a defense that may be available for the criminal defendant. Do not rely on your memory from a previous case or previous work. Keep in mind, depending on when you read the case, you may have learned a great deal since. Take the time to reread the case and brief it again. Do not rely on you previous work. It could seriously reduce your grade if you missed something previously.

• Complete a 2-page paper about a crime against property or a drug/ alcohol crime. Use the case information from the text and find a defense that could have been used. You may have to include one or two additional facts that are not in the facts of the case to make a defense work. This is acceptable within reason
• Ensure the following elements are addressed.
  • Select a statute and case
  • Identify the elements of the statute
  • Using the case find the facts that a prosecutor would use to meet his or her burden of proof
  • Provide at least two sources.
