Objective 2: Integrate critical thinking and ethical decision making strategies to address ethical dilemmas as they relate to both legal and ethical considerations.
Ethical decisions are not always clear cut, and there is not always an obvious answer. The process becomes even more complex when we consider legal versus moral considerations. Professional dilemmas like this can occur when we try to make decisions based on our judgment yet legal or moral considerations do not necessarily align with that decision. It is our professional obligation to base decision making on what serves the best interest of the client, while at the same time abiding by legal and ethical rules and guidelines.
An article in Social Work Today presents a case scenario that describes how ethics and legality can collide. A human services worker was providing services to an abused wife who recently attempted suicide. However, the state governor put out an executive order that professionals could no longer provide services to undocumented immigrants, which happened to be the client in this story (Reamer, 2008). If the human services worker continued treatment, he would violate a state legal order. If he stopped services, he would violate the moral and ethical code.
